The federal appeals court ruled on Tuesday that it would rehear the case concerning the executive power with an larger panel of eleven justices. The judicial body also vacated a earlier decision from a three-judge panel that had sided with the administration.

Ongoing Dispute Over Troop Deployment

This order represents the latest development in a long-running legal battle over whether the administration has the legal right and valid reason to send national guard forces in Portland. Approximately two hundred troops have been in limbo since the end of September when the deployment effort was started in due to ongoing demonstrations.

Conflicting Arguments

The federal government has argued that government employees at the ICE facility in the southern part of the city were facing threats, while local authorities assert that municipal police have control of the situation.

In defiance of descriptions of Portland as a conflict zone, residents have been posting videos of lush hiking trails and a thriving food scene, and organizing events such as an Emergency Naked Bike Ride against the “militarization of our city”.

Recent Legal Actions

The appeals court decision came after a federal judge in Portland enacted two legal injunctions this period – one blocking the federal control of the Oregon national guard, and another prohibiting the use of any national guard troops in the state, after efforts to evade the first order by calling up troops from California.

On Monday, the ninth circuit panel had put the first ruling on hold – permitting control of state troops – but the second ruling stayed effective, blocking the actual deployment of the forces.

The Tuesday decision means the matter will be heard by the full court – with all decisions under consideration simultaneously – by a panel of eleven justices.

“This decision demonstrates that the truth matters and that the judicial system are striving to hold this administration accountable. The constitution restricts the executive authority, and local populations cannot be treated as a testing site for unchecked federal authority,” stated the legal representative in a statement.

“The court is sending a definite signal: the president cannot dispatch the military into US cities without cause. We will continue protecting state legislation, principles, and sovereignty as this legal proceeding progresses and our legal battle continues in the courts.”
